摘　要：

近年来，全球治理体系深度重塑，国际法治发生结构性嬗变，呈现出多主体参与、网络化运行、规范碎片化与多元价值博弈的特点。传统的程序性、实质性和功能性国际法治理论范式及既有的国际与区域国际法治实践，在面对国际法治嬗变时存在诸多局限。习近平法治思想关于国际法治的系列论述，从主体、结构、规则与价值四个维度对国际法治嬗变作出系统性回应：以实质性主权平等与合作共赢重塑国际法治主体间的互动逻辑，以推动构建新型国际关系为实践路径，拓展多元主体参与国际法治的现实空间；以真正的多边主义理念重塑国际法治权力配置，以共商共建共享的运行机制推动国际法治结构由权力主导向协商共治转型；以开放包容与可持续发展理念回应国际法规则碎片化的挑战，以多维行动体系促进规则遵守、对接与协调；以全人类共同价值夯实国际法治正当性基础，在多元价值博弈中凝聚全球价值共识。习近平法治思想以理论与实践相结合的方式，推动国际法治沿着合作、共治和可持续的轨道向前迈进。

 

On Structural Transformation of International Rule of Law And China's Innovation

——Theoretical Construction and Practical Logic of International Rule of Law In Xi Jinping Thought on the Rule of Law

Abstract  In recent years, the global governance system has undergone profound restructuring, and international rule of law has experienced structural transformation, characterized by multi-actor participation, networked operation, normative fragmentation and the game of diverse values. Traditional theoretical paradigms of the international rule of law—procedural, substantive, and functional—as well as existing international and regional legal practices find them overstretched in addressing these transformations. The series of arguments on international rule of law within Xi Jinping Thought on the Rule of Law provides a systematic response to these changes from four dimensions of actors, structure, rules and values. First, they redefine the interaction logic among participants in international rule of law through substantive sovereign equality and win-win cooperation, expanding the practical space for the participation of diverse actors by constructing a new type of international relations as the practical path. Second, they reconfigure power distribution of international rule of law with true multilateralism, advancing the shift from power-dominated to consultative co-governance via mechanisms of extensive consultation, joint contribution and benefit sharing. Third, they respond to the challenges of normative fragmentation through openness, inclusiveness and sustainable development, while promoting compliance, alignment and coordination of rules through a multidimensional framework of action. Fourth, they consolidate the legitimacy of international rule of law with common values of humanity and forge a broader global consensus amid value pluralism. By integrating theory with practice, Xi Jinping Thought on the Rule of Law advances international rule of law along a cooperative, co-governed and sustainable trajectory.
