摘　要：

在法治乡村建设中，村级组织的纠纷解决能力体现为综合运用多种解纷资源有效化解乡村日常社会纠纷的能力。从纠纷解决的法治实效看，村级组织的纠纷解决能力面临挑战，不少乡村纠纷的解决效果并不理想。在乡村社会关系松弛的背景下，乡村治理形态的科层化不利于村级组织解纷治权的累积，削弱了村级组织解决纠纷的能动性。在解纷能力的构成上，村级组织的纠纷解决能力应包含契合乡村纠纷特性的解纷适配能力、满足乡村纠纷解决需求的解纷回应能力和促成解纷资源有效供给的解纷供给能力。为此，村级组织纠纷解决能力的建设不仅要充分发掘蕴藏于乡村社会内部的本土资源，还应当着力增强对解纷资源的统筹和整合，具体包括建构有助于激活解纷资源的解纷治权累积机制、提高多元解纷资源供给与解纷需求之间的适配度、以综合统筹为公共法律资源增效赋能。如此，村级组织的纠纷解决能力才能获得实质性提升，法治乡村建设中社会矛盾有效化解在基层的治理目标才有望达成。

 

On the Dispute Resolution Capacity of Village-level Organizations in Strengthening Rule of Law in Rural Areas

Abstract In strengthening rule of law in rural areas, the dispute resolution capacity of village-level organizations is reflected in their ability to effectively resolve daily social disputes by comprehensively utilizing various dispute resolution resources. Judged by effectiveness of rule of law in dispute resolution, village- level organizations face challenges in their dispute resolution capability, with some of them far from satisfactory. Under the background of loosening social relationships in rural areas, the hierarchical model of rural governance is not conducive to the accumulation of dispute resolution authority for village organizations and undermines their initiatives. In terms of its composition, the dispute resolution capacity of village-level organizations should include the dispute resolution capacity tailored to the characteristics of rural disputes, the dispute resolution responsiveness meeting the needs of rural dispute resolution and the dispute resolution supply capacity facilitating the effective provision of dispute resolution resources. Therefore, the strengthening of dispute resolution capacity of village-level organizations should not only tap into the local resources within rural society, but also strengthen the overall planning and integration of those resources. Specifically, it includes building the accumulation mechanism of dispute resolution authority to activate dispute resolution re‐ sources, improving the alignment between diversified supply of dispute resolution resources and actual needs and enhancing the efficiency of public legal resources through Party-government coordination. Only in this way, can the dispute resolution capacity of village-level organizations be substantially improved and the governance goal of effectively defusing social conflicts in strengthening rule of law in rural areas be achieved.
